You (the client), agree that you have read, agreed, and fully comprehended the material presented to you. You additionally agree to all terms and conditions once you check out, which gives consent that you have read, agreed to, and fully comprehended the following information:
Hours: The Glamphics Blueprint operates Monday-Friday from 10 AM-9 PM CST. The Glamphics Blueprint is CLOSED on weekends and all holidays.
Payments + Charges: Pricing at The Glamphics Blueprint is subject to change at any time. If there has been agreed-upon pricing between The Glamphics Blueprint and the client before changes have been made, it will remain valid until that project is complete. You (the client) understand that in order for The Glamphics Blueprint (the designer/s) should start any service, you must pay in full the costs of any service that will be provided. Projects and services purchased on www.theglamphicsblueprint.com are paid in full before the project begins. Deposits are ONLY prohibited when you pay for services $300+, in that case, You (the client) are required to a minimum of a 50% deposit (an invoice will be sent to your email). The final 50% payment will be due within 72 hours of your final approval of your designs before the project is canceled without refund. All website development must be paid in full before the project can be started, with NO exceptions. Once the final payment is made, the project will be finalized and all files will be sent to you via email. All payments must be made with a debit/credit card on www.theglamphicsblueprint.com. Cash is not ever accepted. No project will be finalized without full payment first.
Refunds + Cancellations: The Glamphics Blueprint only offers refunds if the project has not already been started within 14 business days from the purchasing date. Once a purchase has been designed through The Glamphics Blueprint, the project will begin in the time frame given to the client, after the design form is filled out. We always provide reasonable time frames to our clients however, there may be an additional business day or two needed before we can begin, due to peak times. If for any reason you want to cancel a service already rendered or paid for, or after the project is finalized, due to the work produced or in the queue, payments already received by The Glamphics Blueprint will not be refunded in order to balance the loss of the business. If partial work has already been given to the client and they choose to cancel, the partial or full payment that has been paid will not be refunded. Ownership of all artwork, layouts, and development will remain the property of The Glamphics Blueprint and the remaining work will not be sent to the client for their ownership. If the project is in the final stage, ownership will be transferred to the client after full payment is received.
The Glamphics Blueprint has the right to turn away or stop working with any client who is not following The Glamphics Blueprint's prices, or policies. Acting in such a manner will result in immediately declining the client or terminating/ending a current project without a refund for any purchase or payment made, for that current project. The Glamphics Blueprint will no longer serve a client if a project has been canceled in the past by The Glamphics Blueprint, due to them now following the policies of The Glamphics Blueprint.
Additionally, requests for refunds may be granted, in the event The Glamphics Blueprint team is unable to do the project for personal reasons, emergencies, or sickness. We do NOT provide refunds for buyer's remorse (the sense of regret after having made a purchase).
Disputes + Chargebacks: If you, the client, for some reason decide that you want to dispute our order without communicating with us first to fix the problem, you WILL BE BANNED from our site and will not be able to book again! Please communicate with us first because we want to make sure all of our clients are satisfied!
The client agrees that they will give full details/ description to the designer. If information is not sent, please refer to the Ghosting Clause for additional information. The client also understands that what is submitted on the design form will be used for the design.
Final Copies, Samples, and Revisions: All design projects are sent to you (the client) in the form of an email from The Glamphics Blueprint (the designer/s). Logo designs will always be sent in JPG, PNG, PDF, SVG, and AI formats. Brand identities include black and white PNG versions. EPS files can be sent upon request, you (the client) have 14 days after the project is finalized to request files, after those days, the client will be subjected to a $50 for each additional file type. Other projects such as flyers, business cards, website graphics, etc. are sent in JPG or PNG format. Don't hesitate to get in touch with The Glamphics Blueprint if PDF files are needed. You (the client) also understand that once he/she has received the final copies for their design, they can NOT ask for any additional changes. If they do so, you will be charged for the price of a new design. All original. PSD & AI files are to remain in the property of The Glamphics Blueprint, even if a copy was sent to you.
Copyrighting and/or trademarking your logo is not the responsibility of The Glamphics Blueprint. You "The Client" also give The Glamphics Blueprint the right to use designs and samples for portfolio and/or marketing reasons unless stated otherwise. No final designs or files will be sent without full payment. Sample images of ANY kind are for the purpose of approval only. They may not be copied, manipulated, or distributed to anyone or any company other than those directly involved with the project without prior permission from The Glamphics Blueprint, All project samples are the property of The Glamphics Blueprint. For the majority of projects done by The Glamphics Blueprint, there are unlimited revisions, within reason. The Glamphics Blueprint will under NO circumstances incorporate another graphic/web designer's work into our own or copy another designer's work to where it looks exactly the same. You may send examples of work you have seen that you like for inspiration, and The Glamphics Blueprint will let you know if we can or cannot create a SIMILAR design for you. Still, they will never be exactly copied or incorporated due to legal reasons.
Turnaround Times & Rush Orders: You (the client) understand that they will receive their design in 5-14 days for Logo Designs + Brand Essential Services, and 28-31 business days/4 weeks for design packages and websites. (WEEKENDS NOT INCLUDED). Custom packages can take up to 2 months to complete depending on package size. We work diligently to deliver services promptly. However, turnaround times could be extended due to unforeseen circumstances, including but not limited to high order volume, personal emergencies, health problems, and more. Revisions take 1-4 business days to complete but can take up to 5 depending on workload! Please also understand communication is key. Once you send information for any work, that's when we're able to begin working. Delayed responses for design work, can affect design turnaround. The turnaround time for all Graphic Design Services begins when FULL ADVANCE PAYMENT has been made, design form is completed and all content (i.e., images, pictures, bio, information, links, etc.) for the design project has been supplied by the CLIENT.
You (the client) understand that for any rush order, you will be subjected to a $100 fee. Adding this to your service can bump up your project turnaround time to 3-14 business days, depending on the service (brand packages and website design services, may vary).
The Glamphics Blueprint is NOT responsible if the client decides not to read our terms & conditions. DESIGNER has all rights to cancel an open project due to no response after drafts are sent after a 72-hour grace period, with no refund.
Communication: All communication with The Glamphics Blueprint is to be done via email, other forms of communication may be requested such as texting (for Retainer clients ONLY), and direct messaging through our business socials. Phone calls and consultations are free with every service. Please allow up to 24 hours for a response. The Glamphics Blueprint does not respond to clients outside of business days and hours (See above). We appreciate our clients to be very attentive during the design process. Please understand that after you receive your designs, or after you place your order you need to respond/or send your information in a timely manner. No longer than a week. If you take more than 7 days to respond to emails, you will placed at the end of our list and your revisions/final copies will be sent once we get to you. If you do not respond or send information within 10 days, you will be charged a $75 restart fee. If you do not respond or send information in over 15 days, your order WILL be canceled and you will not be granted a refund under ANY circumstances.
Copyright Ownership: In the event that any copyrighted work(s) are created as a result of the Services provided by the Designer in accordance with this Agreement, the Designer owns all copyrights in any and all work(s) it creates or produces pursuant to federal copyright law (Title 17, Chapter 2, Section 201-02 of the United States Code), whether registered or unregistered. Any and all products, whether tangible or intangible, produced or created in connection with, or in the process of fulfilling this Agreement, are expressly and solely owned by the Designer and may be used in the reasonable course of the Designer's business.
Permitted use of services/products: The Designer grants the Client a non-exclusive license of the product(s) produced with and for the Client for personal use only so long as the Client provides the Designer with attribution each time the Client uses the Designer's property. Personal use includes, but is not limited to, use within the following contexts:
The client may not copy, duplicate, distribute, republish, or incorporate the Deliverables or allow others to copy, duplicate, distribute, republish, incorporate, or use the Project.
The client may not crop, distort, manipulate, reconfigure, mimic, animate, create derivative works, extract portions, or in any other manner, alter the Final Art. All copyright, trademarks, design rights, and other intellectual property (registered and unregistered) shall remain vested in the Designer. The Client agrees that such proprietary material is solely for the Client's own personal use.
Any disclosure to a third party, copying, or republishing of any portion of the Deliverable or its contents is strictly prohibited and constitutes infringement.
Grant of Rights: The Designer has agreed to the perpetual license of the right to display and transmit work to the Client and reserves the right to any and all proofs or drafts shared with the Client during the initial stages of the design process, including design styles, patterns, placements, graphics/edited photos used to complete the draft for revision. These initial designs are for viewing purposes only and should not be shared, used, modified, or resold in any way by the Client or any unauthorized personnel.
The Client continues to own any and all proprietary information provided in the information collection form, including intellectual property and related material shared during the design process, during the term of this Contract for the purposes of the contract. The Designer has no rights to this proprietary information and may not use it except to complete the services originally booked/purchased. Upon completion of the contract, the Client will own the final Graphic Design Deliverables.
